The Company does not guarantee that Services will be available at all times or in all locations. Service availability is subject to driver capacity, geographic coverage, operational conditions, and other factors within or beyond the Company's control.
The Client acknowledges and agrees that various factors beyond the Company's reasonable control — including but not limited to traffic conditions, weather events, road closures, acts of God, governmental actions, civil unrest, vehicle breakdowns, and technology failures — may affect scheduling and the timely provision of services.
Motion Miles Logistics does not guarantee specific delivery times unless expressly agreed to in writing. Estimated pickup and delivery windows are provided as a courtesy and do not constitute a binding commitment.
All information provided through our website, booking platform, and client communications is provided on an "as-is" and "as-available" basis. The Company does not warrant that the website or booking platform will be error-free, uninterrupted, or free of viruses or other harmful components.
The Client is solely responsible for providing accurate, complete, and current delivery information at the time of booking. Motion Miles Logistics shall not be liable for delays, failed deliveries, or additional costs arising from incorrect, incomplete, or misleading information.
The Company shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising from the use of our services, except to the extent such damages result from the proven gross negligence or willful misconduct of Motion Miles Logistics.
Motion Miles Logistics reserves the right to cancel or refuse service at its discretion, including but not limited to situations involving safety concerns, suspected fraud, prohibited items, or violation of our Terms of Service.
Any disputes or claims arising in connection with this Disclaimer shall be governed by the laws of the State of Texas and shall be subject to the exclusive jurisdiction of the courts located in Travis County, Texas.
