Terms of Service
Motion Miles Logistics | Effective Date: June 2026
These Terms constitute a legally binding agreement between you ("Client") and Motion Miles Logistics ("Company"). By accessing or using any services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Scope of Services

Motion Miles Logistics provides same-day courier and last-mile logistics solutions, including scheduled deliveries, on-demand services, priority runs, and business-to-business logistics support (collectively, the "Services"). The specific nature and scope of Services shall be as set forth in the applicable order confirmation, service agreement, or booking.

2. Availability of Services

Submission of an order request does not guarantee acceptance. Motion Miles Logistics reserves the right to decline, delay, or reschedule services based on operational capacity, driver availability, safety concerns, or other business considerations. The Company shall not be liable for any loss or damages arising from the unavailability of Services.

3. Bookings and Payments
  • All bookings must be made in advance through our designated website, online platform, or authorized booking system.
  • Full payment of all applicable fees is required to confirm and secure the requested Services.
  • The Client agrees to provide accurate, complete, and current information for all bookings and payments.
  • Payment terms, surcharges, and pricing adjustments are governed by our Pricing Policy.
4. Cancellations and Refunds

Cancellation and refund eligibility are governed exclusively by the Cancellation Policy. In the event of a conflict between these Terms and the Cancellation Policy, the Cancellation Policy shall control.

5. Right to Refuse or Cancel Service

Motion Miles Logistics reserves the right, at its sole discretion, to refuse, suspend, or cancel any order or Service, in whole or in part, without prior notice, for reasons including but not limited to safety concerns, scheduling conflicts, suspected fraud, violation of these Terms, or non-compliance with applicable laws or regulations.

6. Liability and Damage

The Company shall exercise reasonable care in the handling and transportation of goods. The Company shall not be liable for any loss, damage, delay, or failure to perform caused by:

  • Improper or inadequate packaging by the Client or third parties;
  • Acts of God, force majeure events, weather conditions, or other circumstances beyond the Company's reasonable control;
  • Acts, omissions, or interference by third parties not under the Company's direct control.

Except as otherwise expressly provided in Section 3 (Cargo Claims) of our Limitation of Liability Policy, in no event shall Motion Miles Logistics' aggregate liability exceed the total amount paid by the Client for the specific Service in question.

7. Client Warranties and Obligations
  • The Client represents and warrants that they are authorized to request the Services and that all information provided is accurate and complete.
  • The Client represents and warrants that it owns, possesses, or is otherwise authorized to tender all items submitted for delivery.
  • The Client agrees to comply with all applicable laws, regulations, and these Terms.
  • The Client is responsible for ensuring that items tendered for delivery are properly packaged, labeled, and compliant with all applicable shipping regulations.
  • The Client agrees not to tender for delivery any items that are prohibited by law, hazardous, or otherwise restricted without prior written authorization.
8. Electronic and SMS Communications

Transactional Notices: By using the Services, the Client consents to receive transactional communications electronically, including order confirmations, invoices, delivery updates, and policy notices. Electronic communications satisfy any legal requirement that such communications be in writing.

SMS/Text Communications: By providing your mobile telephone number, you expressly consent to receive automated operational text messages (SMS) regarding order status, driver dispatch, and delivery confirmation. Consent is not a condition of purchase, and message and data rates may apply. You may opt out at any time by replying STOP.

9. Indemnification

The Client agrees to indemnify, defend, and hold harmless Motion Miles Logistics, its affiliates, officers, directors, employees, agents, and subcontractors from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to the Client's breach of these Terms, violation of any applicable law or regulation, or negligence or willful misconduct.

10. Prohibited Items

The Client shall not tender for delivery any of the following items without prior written authorization:

  • Hazardous materials, flammable substances, or explosives
  • Illegal substances or contraband
  • Live animals
  • Currency, negotiable instruments, or irreplaceable documents
  • Items prohibited by applicable federal, state, or local law
11. Modifications to Terms

Motion Miles Logistics reserves the right to modify, amend, or update these Terms at any time. Any changes will be effective immediately upon posting on our website. Continued use of the Services following any posted modification constitutes the Client's acceptance of the revised Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Texas. Any disputes shall be resolved exclusively in the courts of competent jurisdiction located in Travis County, Texas.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with any applicable order confirmations, service agreements, and policies referenced herein, constitute the entire agreement between the Client and Motion Miles Logistics and supersede all prior agreements, representations, and understandings.
